三創生活園區開幕近4個月，知名樂團八三夭上月底在園區5樓舉行「生日趴」音樂表演活動，遭民眾檢舉違規，經北市府認定確實不符合土地使用分區規定，已發函限期2個月內改善。三創則表示，「將不懼謠言，積極與市府團隊溝通」，依法依規完成各項程序，打造世界級的展演空間。都發局副局長張剛維表示，經過都發局和文化局、商業處認定，八三夭8月28日在三創的活動是售票性質音樂表演，不符合該處「一般零售業」允許的用途。目前違反《都市計畫法》79條的處理方式，皆是發文限期2個月內改善，否則就開罰6萬至30萬元；所以雖然表演已結束，都發局仍發文要求三創不能再辦類似活動。

張剛維說，若該空間未來要當作長期表演的場所，必須修改土地使用分區規定；三創之前反映想做多功能展演場，都發局已要求業者列出未來可能的用途，以協助檢視是否符合分區規定。昨天柯文哲出席教育局活動時被媒體問到此事，他說，如果三創5樓（因為受限法規）不能改成live house，「那台北市（其他live house）大概都完蛋」，所以還是實事求是，對北市live house要有合理的規範，把標準法制化。三創昨晚發出聲明回應，「感謝柯市長對於三創5樓空間規畫的肯定。」多年來，台灣藝文團隊苦無合格的表演舞台，文創軟實力快速消退，三創生活園區創設之初就期許，規畫最優質的中小型展演空間。自2014年7月以來，文化部、內政部陸續發函，鬆綁小型表演館（場）相關法規，三創依照法規打造一流的展演場地，呼應柯市長的競選政見、以及台灣藝文團隊的長久等待。三創表示，「將不懼謠言，積極與市府團隊溝通」，依法依規完成各項程序，打造世界級的展演空間；期待各界支持，讓台灣藝文團隊再度發光發熱。(中國時報)，
